Submit a ClaimLegal collection can be started once the deadline set in your formal-reminder has passed without your debtor having balanced his account. At MMrecht debt collection always starts with a first-assessment of your case. As described in the section on the Mahnverfahren we require some details for our first-assessment and in order to initiate the legal recovery of your debt against a debtor in Germany.
Required Documents About the Creditor: 1. Name and Address. 2. Extract from the Commercial Register.
About the Debtor: 1. Complete and correct company name (thus including the GmbH, OHG suffix). 2. Address. 3. First and Last name of CEO (Geschäftsführer).
About the claim: 1. Type of claim (e.g. delivery of goods). If possible the date of the contract on which the claim is based and a copy of that contract in case it's a written one. 2. The amount of the total claim. Attach an account overview to explain which parts of the claim derive from what process, if necessary. 3. Copies of the documents informing your debtor about his overdue account, such as invoices or reminders. 4. In case negotiated for, the base and amount of the contractual interest rate for the overdue debt. Please indicate the start date for the calculation of the interest rate in case of multiple contracts (overdue payments). 5. Also state the amount of your extrajudicial debt collection costs. These are rarely accpted by German judges however. 6. Last but not least, a copy of your terms & conditions, if applicable. Please get in touch with us if you do not know the exact details and whereabouts of your debtor. We have a good history of locating debtors with almost no information at hand.
